REFER & EARN / AFFILIATE PROGRAM TERMS AND CONDITIONS

This agreement has been made between Kittcoin and the Affiliate. The Affiliate has completed their registration and ensures that all account information is accurate and up-to-date. After approving these terms and conditions, the Affiliate may begin marketing the Kittcoin website.

1. COLLABORATION

1.1 The Parties engage in collaboration, as part of which the Affiliate markets the Kittcoin service and obtains new Kittcoin clients.

1.2 The Affiliate is entitled to receiving Kittcoins as a reimbursement in return for new clients.

2. REIMBURSEMENT OF THE AFFILIATE

2.1 For each new approved client who registers with Kittcoin, the Affiliate is entitled to receive two hundred (200) Kittcoins. It should be noted that additional reimbursements may be agreed upon with Affiliates who attract new clients either professionally or in large numbers.

2.2 In general, two hundred (200) Kittcoins are transferred in near real-time to the client account of the Affiliate in return for each obtained and approved client. Potential further reimbursements are usually manually completed once per month.

3. TRACKING

3.1 Kittcoin provides the Affiliate with a URL, i.e., a tracking link, and all clients who register with the service using that URL are assigned to the Affiliate.

3.2 The Affiliate is not given access to client personal data.

3.3 Kittcoin provides a web interface which the Affiliate may use to observe statistics and download marketing materials.

4. RESPONSIBILITIES OF THE AFFILIATE

4.1 It is the responsibility of the Affiliate to ensure that only authorized persons are allowed to use and manage the Affiliate account. Kittcoin holds no responsibility over unauthorized events performed using the Affiliate account.

4.2 The Affiliate alone is responsible for reporting taxes (should they be collected) and paying them to local authorities. Kittcoin is in no way responsible for taxes of the Affiliate or any other possible payments/costs.

4.3 The Affiliate must not, under any circumstance, present excessive promises or descriptions in relation to Kittcoin or to suggest in any way the potential future value of Kittcoins.

4.4 The Kittcoin code system should be utilized by the marketer only and for no other reason than to promote Kittcoin marketing. As a whole, the Kittcoin service is exclusively for adults and the marketer must take this into consideration. Misuse leads to affiliate account closure and loss of Kittcoins in full.

4.5 All types of spamming are explicitly forbidden.

5. GENERAL TERMS

5.1 The Affiliate is fully responsible to Kittcoin over all actions of the Affiliate’s employees or third-party contractual partners.

5.2 Kittcoin makes no promises about the future value of Kittcoins and we do not permit anyone to make promises on our behalf. 

Kittcoins are virtual coins that are not based on any blockchain technology. They do not constitute legal tender, electronic money, or a financial instrument, and they hold no intrinsic monetary value outside the Kittcoin service. Kittcoins can only be redeemed and stored within the Kittcoin platform, and their use is strictly limited to the features and functionalities provided by the service.

Goal of the Kittcoin project is to merge with a real cryptocurrency. In the event of such a merger, Kittcoin holders may be given the opportunity to exchange their Kittcoins for the relevant cryptocurrency, subject to the terms, conditions, and agreements negotiated at that time. Kittcoin makes no guarantee as to the timing, success, or specific outcome of such a merger.

Important: Kittcoin makes no promises about the future value of Kittcoins and we do not permit anyone making promises about this on our behalf.

5.3 Kittcoin and the Affiliate concede that, at relatively frequent intervals, due to faulty equipment or delivery issues, the services specified in this agreement may be temporarily compromised. The Parties concede and agree that Kittcoin, the Affiliate or none of their members, partners, executives, personnel, employees or representatives are responsible for any specific, indirect, consequential, punishable or exemplary damages in relation to these temporary disturbances. The Parties also agree that the ability of Kittcoin to complete its responsibilities as defined in this agreement may depend on official permits within any judicial domain. Kittcoin may not be held responsible for any damages that may be caused by changes in legislation or official regulations, or the decision of Kittcoin to provide or not provide services in specific countries.

5.4 The Affiliate understands and approves that the ability of Kittcoin to provide services depends, in certain cases, on third-party subcontractors. Kittcoin may not in any way be held responsible for failing to fulfil its obligations as specified in this agreement due to reasons related to such subcontractors or the annulment of contracts with third parties.

5.5 Neither Party is responsible for failures in implementing this agreement due to reasons beyond reasonable management by the Parties.

5.6 Kittcoin and the Affiliate commit to close collaboration for the benefit of both Parties.

5.7 The Affiliate is liable to compensate and recognizes that Kittcoin may not be held responsible in the event of the conditions of Article 6 being violated.

5.8 Kittcoin retains the right to change the terms and conditions in their entirety.

6. RIGHTS AND RESPONSIBILITIES

6.1 The Affiliate performs marketing on behalf of the Kittcoin service and is responsible for doing so in agreement with currently applicable laws and in a manner that ensures the goodwill value of both Parties or the integrity of trademarks associated with Kittcoin and/or its business partners, without causing risk to them. Marketing activities undertaken by the Affiliate or the general behavior of the Affiliate must not violate the privacy or public image of any third party, and must not include any insulting, inappropriate, facetious or otherwise illegal material concerning any persons or Kittcoin. Kittcoin holds the right to forbid any marketing efforts in accordance with its own consideration, regardless of the reason.

6.2 The collaboration between Kittcoin and the Affiliate does not under any circumstance form a bond of employment and Kittcoin is under no circumstance responsible for the time management of the Affiliate, nor any costs.

6.3 Kittcoin has the right to publish news about Affiliates/collaborators and to tell about cooperation in general, for example via newsletters or in any other way that can eventually help Kittcoin. Kittcoin does not need a separate permission.

6.4 When interpreting these terms and conditions, the laws of the country specified by Kittcoin apply and disputes will primarily be attempted to be resolved through mutual negotiation.

6.5 This agreement is valid once the Affiliate approves these terms and conditions using the Kittcoin service and remain valid indefinitely, unless either Party terminates the agreement.

6.6 Kittcoin holds all rights to changes without separate notice.
